ECP approaches SC to review its decision for polls in Punjab on May 14

ISLAMABAD: The Election Commission of Pakistan (ECP) on Wednesday  filed a plea in the Supreme Court seeking a review of its orders to hold elections in Punjab on May 14.

The ECP submitted that the court did not intervene in its affairs.

 In a 14-page petition, the electoral body stated that the superior courts of the country have been granted a special power under Article 199 and Article 184 (3) of the Constitution to decide matters involving public bodies.

The ECP also submitted that the superior courts could define the contours within which the power vested in the public bodies is or is to be exercised.

The plea moved by the Election Commission of Pakistan argued that at no instance could the superior courts take upon themselves the role of public bodies.

 The ECP pointed out that fixing the date for the election was not the mandate of the top courts under the law, arguing that such powers existed elsewhere under the Constitution but surely did not lie in the court of law. The electoral body also mentioned the various legalities and reasons behind its statement.

Moreover, the ECP held the apex court responsible for disregarding its constitutional jurisdiction, stressing that it had adopted the role of a public body in setting a date. The ECP contended that intervention by the court was necessitated to correct an error that had effectively changed the settled constitutional jurisprudence of the country. The electoral body also pointed out that the august court overlooked material questions of the Constitution and law that had a material bearing on the decision.

In its plea, the ECP stated that “the errors of law are floating on the face of the record and are manifest and clear that these may not be allowed to remain as such.” The electoral body asked the top court to review its ruling and recall the same in the interest of justice and equity. The plea came hours after the Pakistan Tehreek-e-Insaf (PTI) said that it would file a detailed report of talks with the coalition government regarding the elections across the country.

According to reports, both the coalition government and the PTI agreed to hold simultaneous elections across the country, but they had yet to decide the date. The top court had nullified the ECP’s decision to delay the elections in Punjab until October 8. On April 4, a three-member bench of the Supreme Court, headed by Chief Justice of Pakistan Umar Ata Bandial and comprising Justice Ijazul Ahsan and Justice Munib Akhtar, announced the verdict on the plea of Pakistan Tehreek-e-Insaf (PTI) against the delay in the elections in Punjab until October 8.
