IHC stops authorities from arresting PTI’s Fawad Chaudhry till May 17

IHC stop the arrest of PTI leader Fawad Chaudhry till May 17.

ISLAMABAD: The Islamabad High Court (IHC) has granted a two-day protective bail to Fawad Chaudhry, a senior leader of the Pakistan Tehreek-e-Insaf (PTI) party. The court has prohibited authorities from arresting him within the federal capital until May 17.

Earlier today, shortly after being released on bail, Fawad Chaudhry hurriedly returned to the court to avoid potential arrest. Police officers approached his car as he was leaving the IHC premises. In a quick attempt to evade arrest, the PTI leader swiftly exited his vehicle and sought refuge inside the IHC building. He is presently in the courtroom accompanied by his legal representatives.

Interestingly, the police made an arrest attempt despite Fawad submitting an undertaking to the IHC, pledging not to violate Section 144 or participate in protests.

Subsequently, Justice Mian Gul Hasan Aurangzeb of the IHC presided over Fawad’s petition for protective bail in all cases. The court requested the advocate general to provide details about the cases against the PTI leader, and it was revealed that two cases were registered against him.

The bail plea of Fawad was granted by the IHC, and they instructed the appropriate authorities to deliver a copy of the verdict to the Islamabad police chief through a designated “special messenger.”

Earlier in the day, the IHC declared the arrests of Fawad Chaudhry, Shireen Mazari, and Senator Falak Naz under Section 3 of the Maintenance of Public Ordinance (MPO) as “illegal.” The court ordered their release while hearing separate petitions.

At the hearing of Fawad Chaudhry, Islamabad Advocate General Barrister Jahangir Jadoon made an appearance before the bench consisting of a single judge and provided the court with relevant information.  He mentioned that the court order was not given to the IG office and law officers, and Fawad’s biometric verification was also not conducted.

In response, the judge reprimanded the lawyer, emphasizing that it was the court’s authority to determine whether the biometrics had been completed.

Furthermore, the advocate general argued that Fawad Chaudhry had not been arrested in any case. He stated that if an arrest had been made under a case, Fawad would have been required to be presented in court.

The lawyer further contended that Fawad’s conduct should demonstrate whether he is a peaceful citizen of Pakistan or not, mentioning the losses incurred due to the incidents on May 9.

In response, Justice Aurangzeb pointed out that the court had not prohibited authorities from taking action on those incidents.

The advocate general mentioned that the court, while preventing the arrest of Imran Khan, had specifically referred to the MPO. If the court had only prohibited arrest in cases, it could have been carried out under the MPO, he added.

The court inquired about who had advised that the arrest could be made under the MPO. The advocate general responded that no one had given them such advice, but they were unaware of the court’s order regarding the arrest.

The government lawyer then presented a tweet by Fawad, posted on May 10, in which he allegedly incited PTI workers to join the protests.

The lawyer argued that Fawad, in his tweet, had stated that it was the responsibility of PTI workers to participate in the protests following Imran Khan’s arrest.

PTI lawyer Babar Awan asserted that the deputy commissioner must be aware of the high court’s arrest order by now. He requested the court to extend the order preventing authorities from arresting Fawad, allowing his client time to contact the relevant court.
