ICC rejects Israel’s appeal to halt war crimes investigation over Gaza
The International Criminal Court (ICC) has rejected Israel’s appeal seeking to halt an ongoing investigation into alleged war crimes committed during the Gaza conflict, delivering a significant legal setback to Israel’s efforts to block the case.
According to international media reports, the ICC Appeals Chamber upheld a lower court ruling that allows the court’s prosecutor to continue investigating alleged war crimes and crimes against humanity committed against Palestinians in Gaza.
Judges ruled that Israel’s arguments did not meet the legal threshold required to suspend the investigation, clearing the way for proceedings related to the Palestine situation to move forward without interruption.
The decision reinforces the ICC prosecutor’s authority to pursue the case despite Israel’s longstanding refusal to recognise the court’s jurisdiction. Israel has repeatedly denied all allegations of war crimes and maintains that the ICC has no legal authority over its actions.
As part of the investigation process, the ICC issued arrest warrants in November last year against Israeli Prime Minister Benjamin Netanyahu and former defence minister Yoav Gallant on charges of war crimes and crimes against humanity. Israeli officials have strongly condemned the warrants and dismissed the allegations as politically motivated.
The ICC probe focuses on Israeli military operations in Gaza following Hamas’s attack on southern Israel on October 7, 2023, which triggered a large-scale Israeli offensive in the Palestinian enclave.
The Appeals Chamber’s ruling is being widely viewed as a major blow to Israel’s legal strategy aimed at delaying or derailing international accountability efforts, while human rights groups have welcomed the decision as a step toward justice for alleged violations during the conflict.
Israel has consistently rejected the ICC’s findings and continues to deny any wrongdoing, arguing that its military operations were conducted in self-defence.
The ruling ensures that the ICC’s investigation into alleged crimes linked to the Gaza war will proceed, keeping international legal scrutiny firmly focused on the conduct of the conflict.
