‘Political people don’t want just decisions,’ remarks CJP Bandial

ISLAMABAD: Chief Justice of Pakistan Omar Ata Bandial remarked that the political issues polluted the environment of the courts and that political parties wanted decisions of their choices.

The top judge gave these remarks while hearing the pleas challenging the Supreme Court Practice and Procedure Bill 2023 clipping the powers of the Chief Justice of Pakistan.

Justice Ijazul Ahsan, Justice Munib Akhtar, Justice Syed Mazahar Ali Akbar Naqvi, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Syed Hasan Azhar Rizvi and  Justice Shahid Waheed were the other members of the bench.

“It cannot be denied that an independent judiciary is a fundamental part of the Constitution and that the allegation is that violation was committed through legislation of a fundamental part of the Constitution for the first time,” remarked CJP Bandial.

The CJP had remarked that it was his authority to form a bench of seven senior judges and a full court. The court had given its decision in the case of Afzal Chaudhry that only the President could initiate a reference against a judge and no reference against a judge can stop him from performing his duties. The judge can continue to work until the Supreme Judicial Council gives its opinion.

The CJP observed that the court had given the same decision in the case of Justice Qazi Faez Isa.

He also observed that the political affairs polluted the environment of the court.

“Political people do not want just decisions. During the election proceedings, some judges were demanded to be made part of the full court,” the CJP further remarked.

The top court also remarked that the decision of the judges of the Supreme Court was  the decision of the court.

CJP Bandial observed, “Every institution is bound by the orders of the Supreme Court. If judges and the judiciary are not respected, there will be no demand for justice,”.

The apex court put off till May 8 further hearing of the petitions challenging “Supreme Court Practice and Procedure Bill 2023” clipping the suo motu powers of the chief justice of Pakistan.

The top court issued notices to different political parties and others including the Attorney General, Supreme Court Bar and Pakistan Bar Council.

The petitions were filed in the top court against the Supreme Court Practice and Procedure Bill 2023 and asked it to declare as illegal and as unconstitutional.

Last month on April 13, the court had barred the implementation of the bill.

The court had ruled that reducing the powers of Chief Justice of Pakistan in the Practice and Procedure Bill 2023 would not  be effective and nor would it be implemented in any way.

The court’s order regarding the implementation of the Practice and Procedure Act held that the Bill interfered with the judiciary’s independence and internal affairs.

Despite the court order, the Practice and Procedure Bill was formally enacted, and after the completion of the approval process, the National Assembly Secretariat issued a notification stating that the Practice and Procedure Bill is now in effect.
