Muzaffarabad: The Supreme Court of Azad Jammu and Kashmir on Wednesday dismissed the appeal of PTI leader Sardar Tanvir Ilyas challenging verdict of the high court regarding his disqualification over charges of contempt of court.
Chief Justice Saeed Akram passed the order on the appeal of Sardar Tanvir Ilyas.
“The tile of the appeal is not correct as it has mentioned Sardar Tanvir Ilyas as the prime minister. If he is the prime minister then there is no need of any appeal,” remarked the chief justice.
The CJ also remarked, “you should file the appeal, so that it could be decided if it is maintainable or not,”.
A day earlier, AJK High Court disqualified Prime Minister Sardar Tanvir ILyas and declared him ineligible even to hold any public office.
“Sardar Tanvir Ilyas committed a contempt of court,” held the court while announcing the verdict, ruling that he was not eligible for any public office.
The court also did not accept the apology tendered by PM Sardar Tanvir Ilyas over his contemptuous remarks and rude behavior.
The court imposed the sentence upon Sardar Ilyas till adjournment of the hearing, and wrote to the Election Commissioner for a new prime minister of the state. The latest reports suggested that he was disqualified over charges of contempt of court as he turned out to be rude before the court.
It is for the first time in the history of Azad Jammu and Kashmir where a prime minister has been disqualified over contempt of court. Sardar Tanvir Ilyas, however, approached the Supreme Court to challenge the verdict of the Azad Kashmir High Court against his sentence.
The AJK superior court on Monday had issued notices to Ilyas and directed him to explain his position regarding his derogatory remarks about the top judiciary in his speeches at different public meetings.
The court through the notices had summoned him to appear before the high court and the apex court Tuesday (today).
Sardar Tanveer Ilyas had earlier indirectly accused the judiciary for affecting the working of the government and interfering into the domain of the executive through the grant of stay orders.
PTI’s reaction:
Pakistan Tehreek-e-Insaf (PTI) General Secretary Asad Umar said, “Tell me whether AJK PM used more contemptuous language or the PML-N leaders and the PPP leaders. They deserve 100 per cent disqualification for contempt of court,”.
Fawad Chaudhary said they would approach the SC against the verdict of the AJK high court. Fawad Chaudhary had said that they respected the court decision and were not agitating like the coalition government did.
