In a recent development, the Supreme Court has expressed concerns over the judgment passed in the Toshakhana case involving Imran Khan, the chairman of Pakistan Tehreek-e-Insaf (PTI). Chief Justice Umar Ata Bandial remarked that the trial court’s swift announcement of the verdict in a single day appeared to be incorrect. He highlighted that there were evident flaws in the decision-making process. However, he clarified that the Supreme Court would not interfere at the moment, opting to allow the Islamabad High Court (IHC) to address the matter. The Supreme Court directed the IHC to hold an appeal hearing and scheduled another Supreme Court session for a potential decision.
The hearing, presided over by a three-member bench led by Chief Justice Bandial, comes after Imran Khan appealed against his conviction in the Toshakhana case. The apex court indicated its intention to return the case to the Islamabad High Court for further examination.
The key arguments in the case revolve around the accusations that Imran Khan, as an elected Member of the National Assembly (MNA) from Mianwali in 2018, failed to disclose assets in his nomination papers. According to the Election Act, MNAs are obligated to provide details of their assets, those of their spouses, and their children to the Election Commission by a designated deadline.
Latif Khosa, the lawyer representing Imran Khan, presented arguments concerning the details of the assets submitted by Khan to the Election Commission. He highlighted that Khan was accused of concealing his and his wife’s assets, prompting a reference to be filed against him. The reference was subsequently sent to the Election Commission.
In the ongoing legal proceedings, questions were raised about the trial court’s decision-making process and the fairness of the trial itself.
