Ex-CJP’s audio leak: Ahmed Khan advises law minister to move reference against judges

LAHORE: Pakistan Muslim League-Nawaz (PML-N) leader Malik Ahmed advised Federal Law Minister Azam Nazir Tarar to move reference against “three judges” of the Supreme court.

“The law Minister is sitting here and he knows better but I ask him to move reference against these judges,” said the PML-N leader while addressing a press conference with Azam Nazir Tarar at PML-N Secretariat in Model Town on Tuesday.

Malik Ahmed Khan said that the judges could interpret the laws but could not rewrite.

He said, “the audio tape could not be ignored. Voting is the right of the lawmakers in the parliament but they were passing through a difficult times,”.

He asked the law minister to adopt any way on the said audio leak.

He stated that the audio leaks raised many questions while Saqib Nisar gave reference of a judgment back in 2012.  Khan said that many political leaders were punished in the name of the contempt of court.

Law Minister Azam Nazir Tarar said the audio leak also referred to many events in the past, saying that the audio leak between Mian Saqib Nisar and lawyer Tariq Rahim is important.

He said that a ground was being made to bring the government officials to dock.

The law minister said that Mian Saqib Nisar should have been more careful but his conversation had surfaced.

The political matters, Tarar said, should not go to the courts.

The controversial decision, he said, caused huge loss to the national cause, adding that the efforts were underway to create clash between the state institutions.

The PML-N leaders’ reaction came after an alleged audio clip of former Chief Justice of Pakistan Saqib Nisar and lawyer Khawaja Tariq Rahim went viral on the social media.

 In the leaked audio, both are heard holding discussion about the contempt of court case.

Saqib Nisar said, “Khawaja, I want to say something,” to which Khawaja Tariq responded with a yes.

Saqib Nisar said, “You should definitely see one judgment, it has 7 members of the bench.” Khawaja Tariq asked in response, “How much?”.

Former Chief Justice said that this will be a suo motu case, number 4 of 2010, and this 7-member judgment is reported on Supreme Court page number 553 of 2012.

Khawaja Tariq said, “Okay, let me check,”  to which Saqib Nisar replied, “Ask your lawyer to have a look at it. It depends on whether, brother, if…Anyway, let’s leave it, when you read it, you will understand yourself.”

Saqib Nisar responded, “Yes, Chief Justice. Khawaja Tariq said that he has also given a way out in it. Please have a look.”.

The former Chief Justice said, “Yes, I have seen it. We have that way out. ” To which Khawaja Tariq replied, “Yes, we have that way out,”.

At this, Saqib Nisar said, “That’s the way out, otherwise the case cannot be made.” To which Khawaja Tariq replied, “Yes, absolutely right. I will also look into this.”

The former Chief Justice said, “And Khawaja Sahib, if you have someone ready, use Munir Ahmed Khan as well. It is a clear case of contempt of court.”

Khawaja Tariq responded, “That is also being done.”

Saqaib Nisar said, “Whatever happened yesterday in Azad Jammu and Kashmir, nothing can happen after that.” Khawaja Tariq replied, “We are waiting for the order of the three-member bench. It can take another hour or half an hour, and after that, we will file a contempt of court case.”

In response to Khawaja Tariq, Saqaib Nisar said, “Alright, that’s fine. Thank you, sir.”
